The Ministry of Health has reopened the deadline to deny the automatic inclusion in the Electronic Health Record 2.0 of health data and documents of services provided before May 2020

The Ministry of Health has reopened the deadlines for objecting to the automatic inclusion in the Electronic Health Record 2.0 of health data and documents of services provided by the Healthcare System before May 19, 2020, in line with the provisions of the Data Protection Authority. From now until Dec. 17, 2024, users can express their opposition by accessing the Tessera Sanitaria (TS) system online, including by using only their health card. The Electronic Health Records, the tool that the National Health Service is enhancing with PNRR funds, contains citizens’ medical records and allows healthcare providers to consult them in order to better care for their patients, even in emergency situations; citizens in Trentino access the Electronic Health Records through TreC+ (from PC or App

The decision to extend the timeframe in which citizens can express opposition to the recovery of past data is aimed at ensuring this right for those who encountered difficulties in exercising it in the previous window between April and June.
The right to object is exercised with a special feature of the national online platform called Sistema Tessera Sanitaria (TS) https://sistemats1.sanita.finanze.it/portale/area-riservata-cittadino.
The window to express refusal to upload of data older than May 2020 will be active until December 17. Excluded from the opposition are digital documents already uploaded to the ESF e-chart for which specific consent has been provided by the patient, as well as drug prescriptions and specialist referrals.
The TS system can be accessed through a tesserea sanitaria card by entering the user’s taxpayer Id. code and tessere sanitaria card number or through digital identity – SPID (Public Digital Identity System), CIE (Electronic Identity Card), CNS (National Services Card) or by entering the STP (Temporarily Present Foreigner) code and its date of issue.
If the user does not have the necessary tools to independently access the TS system, he or she can still exercise the right to object at one of the Apss helpdesks (with appointment): please follow this link for the email addresses where to submit your appointment request.
For information, contact the Apss Public Relations Office at 0461 904172 (8:30 a.m. to 1 p.m.).
The possibility of exercising the right to oppose will be maintained, as of Dec. 17, 2024, only for NHS members who turn 18 (to be produced within 30 days of their 18th birthday) and for foreigners temporarily present or no longer enrolled in the National Health Service for whom the opposition to the prior data or its revocation is not previously expressed, who will be able to exercise the opposition within 30 days of the reactivation of enrollment in the National Health Service, only through APSS operators or operators of the Offices of Maritime, Air and Border Health (USMAF) and Seafarer Health Care Services (SASN).
Opposition to feeding the ESF e-chart with data and documents prior to May 19, 2020, will have no consequences in the provision of health services, but health data created prior to that date will not be available to physicians and health care professionals who, therefore, will not have full information on the health status of the patient, potentially useful for appropriate diagnosis and higher quality of care available.
